1) Introduction

These Terms of Service (“Terms”) govern your use of Durability’s websites, mobile applications, and related services (collectively, the “Services”) provided by Durability (“we,” “us,” or “our”).

2) Acceptance of Terms

By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

3) Eligibility & Accounts

• You must be at least 13 years old (or older if required by your jurisdiction) to use the Services.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
• Provide accurate, current information and update it as needed.

4) Permitted Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal or internal business purposes.

5) Prohibited Conduct

• Reverse engineering, decompiling, or attempting to extract source code from our software.
• Interfering with or disrupting the Services or their security features.
• Using the Services for unlawful, harmful, or fraudulent activities.
• Uploading or transmitting viruses, malware, or harmful code.
• Impersonation or misrepresentation of your affiliation with any person or entity.

6) Beta / Early Access

Certain features may be offered as beta or early access. Such features are provided “as is,” may contain bugs, and may be suspended or discontinued at any time. We may request feedback and you grant us the right to use it to improve the Services without any obligation to you.

7) User Content

You retain ownership of content you submit (e.g., text, images, movement videos, data) (“User Content”). You grant Durability a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, and display User Content solely to operate, provide, and improve the Services.

You represent and warrant that you have all rights necessary to submit the User Content and that it does not infringe others’ rights or violate law.

8) Subscriptions & Payments

If you purchase a subscription or paid feature, you agree to the pricing, billing cycle, and taxes shown at checkout. Unless stated otherwise, subscriptions renew automatically until canceled. You may cancel at any time through your account settings; cancellations take effect at the end of the current billing period.

All fees are non-refundable except as required by law. We may change prices with reasonable notice.

9) Intellectual Property

The Services, including software, models, algorithms, text, graphics, logos, and trademarks, are owned by or licensed to Durability and are protected by intellectual property laws. Except for the limited rights expressly granted here, no license is granted to you by implication or otherwise.

10) Feedback

If you send suggestions or feedback, you grant Durability a perpetual, irrevocable, worldwide, royalty-free license to use and exploit that feedback for any purpose without obligation to you.

11) Third-Party Services

The Services may link to or integrate with third-party services (e.g., email providers, analytics). We are not responsible for third-party content, policies, or practices. Use them at your own risk and review their terms and policies.

12) Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT RESULTS WILL MEET YOUR EXPECTATIONS.

13) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DURABILITY AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES.

14) Indemnification

You agree to defend, indemnify, and hold harmless Durability and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Services or violation of these Terms.

15) Suspension & Termination

We may suspend or terminate your access to the Services at any time if we believe you have violated these Terms or if necessary to protect the Services or other users. Upon termination, your right to use the Services will cease immediately. Sections that by their nature should survive will survive.

16) Governing Law

These Terms are governed by the laws of the State of Massachusetts, without regard to conflict-of-laws principles. The exclusive venue for any disputes shall be the state or federal courts located in Boston, Massachusetts.

17) Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms with a new “Last Updated” date. Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
